for the purchase of vouchers

This withdrawal policy applies to contracts for the purchase of vouchers concluded by
consumers via the online voucher shop of Hotel Tuxerhof GmbH. A consumer is any
natural person who concludes the contract for purposes which are predominantly outside
their trade, business or profession.

 

1. Right of withdrawal
   
   You have the right to withdraw from this contract within 14 days without giving any reason.
   
   The withdrawal period expires 14 days after the day of the conclusion of the contract. If a
   physical voucher is shipped to you, the period expires 14 days after the day on which you,
   or a third party other than the carrier indicated by you, acquires physical possession of the
   voucher.

   of your decision to withdraw from this contract by an unequivocal statement (e.g. a letter
   sent by post or an e-mail). You may use the model withdrawal form below, but it is not
   obligatory. Alternatively, you may declare your withdrawal using the “Withdraw from
   contract” function in our online voucher shop; you will receive confirmation of receipt by e-
   mail without undue delay.
   
   To meet the withdrawal deadline, it is sufficient for you to send your communication
   concerning your exercise of the right of withdrawal before the withdrawal period has
   expired.
   
   
   

2. Effects of withdrawal

If you withdraw from this contract, we shall reimburse to you all payments received from
you, including the costs of delivery (with the exception of the supplementary costs resulting
from your choice of a type of delivery other than the least expensive type of standard
delivery offered by us), without undue delay and in any event not later than 14 days from
the day on which we are informed about your decision to withdraw from this contract. We
will carry out such reimbursement using the same means of payment as you used for the initial transaction, unless you have expressly agreed otherwise; in any event, you will not
incur any fees as a result of such reimbursement.

Upon receipt of your withdrawal, the voucher becomes invalid and will be cancelled by us.
If you have already passed the voucher on to a third party, please ensure that it is no
longer redeemed.


3. Exceptions and early expiry of the right of withdrawal

The right of withdrawal does not apply, or expires early, in the following cases:

Vouchers for services on a specific date: there is no right of withdrawal for contracts
for the provision of accommodation other than for residential purposes, the supply of
food and beverages, or services related to leisure activities, where the contract provides
for a specific date or period of performance. This applies to vouchers already tied to a
specific stay, a date-bound package or a fixed appointment.

Fully performed service: the right of withdrawal expires once we have fully performed
the service, provided that you gave your express prior consent and acknowledged that
you would lose your right of withdrawal upon full performance. In the case of vouchers,
this applies as soon as the voucher has been redeemed and the service has been fully
used.

Business customers: the right of withdrawal applies to consumers only. No statutory
right of withdrawal exists for voucher purchases made by businesses.

For open-value vouchers and service vouchers without a fixed date, the right of withdrawal
applies without restriction.
